Terms of Service

1. Agreement to Terms

By accessing or using MicFront Academy (the "Service"), operated by LOYX Sdn Bhd ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

MicFront Academy is a speech evaluation and tracking platform designed for educational institutions and coaches. The Service allows users to:

• Upload and manage speech videos
• Evaluate speeches using the CDE (Content, Delivery, Engagement) framework
• Track student progress over time
• Manage student profiles and records
• Share student progress with authorized parties

Some schools and outlets charge fees for tuition, programs, or materials offered through the Service. Where that applies, Section 4 (Payments, Billing, Cancellation, and Refunds) below governs those charges.

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account using Google Sign-In. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3.2 Account Types

• Coaches: Can create and manage students, upload videos, and provide evaluations
• School Administrators: Can manage coaches, students, and school settings
• Parents/Guardians: Can view student progress with granted access

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in any activity that may harm the Service or other users.

4. Payments, Billing, Cancellation, and Refunds

4.1 Fees and Billing

Where a school or outlet charges for tuition, programs, or materials, you will be billed by that school/outlet via invoice, or, where enabled, through a third-party payment gateway. Fees, billing cycles, and payment methods are set by your school/outlet and are stated on your invoice.

4.2 Payment Processing

Where online payment is available, payments are processed by a licensed third-party payment gateway (e.g. senangPay). We do not collect or store your full payment card or bank account details — these are handled directly by the payment processor under its own terms and security safeguards.

4.3 Cancellation Policy

You may request to cancel an upcoming paid program, enrollment, or service by notifying your school/outlet administrator. Cancelling does not by itself entitle you to a refund of fees already paid — see the Refund Policy below.

4.4 Refund Policy

All fees paid for tuition, programs, materials, or other services on the Service are strictly non-refundable, regardless of attendance, withdrawal, or early termination, except where a refund is required by applicable law. If a payment is made in error or a billing mistake occurs, contact us at the email address in Section 14 and we will investigate and correct the error at our discretion. Where an overpayment or billing correction results in a credit, that credit is applied toward your future invoices rather than refunded in cash.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on intellectual property rights
• Upload inappropriate, offensive, or harmful content
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service to collect or store personal data about others without authorization
• Share login credentials or allow unauthorized access to your account

6. Content Ownership and Rights

5.1 Your Content

You retain ownership of all content you upload to the Service, including videos, evaluations, and student information. By uploading content, you grant us a license to store, display, and process your content solely for the purpose of providing the Service.

5.2 Our Content

The Service, including its design, features, and functionality, is owned by LOYX Sdn Bhd and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Student Data and FERPA Compliance

If you are using the Service on behalf of an educational institution, you acknowledge that student data may be subject to the Family Educational Rights and Privacy Act (FERPA) or similar regulations. You are responsible for ensuring that your use of the Service complies with applicable laws and that you have obtained necessary consents for student data processing.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOYX SDN BHD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

11. Indemnification

You agree to indemnify and hold harmless LOYX Sdn Bhd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
